Even though associations are nonprofit and generally not subject to property taxes, they must file income tax returns both with California's Franchise Tax Board (FTB) and with the Federal Internal Revenue Service (IRS) and, if necessary, pay taxes. (Internal Rev. Code 528).
Incorporated community associations must pay a minimum annual corporation tax of $800 unless receive an exemption by filing FTB Form 3500. If granted, HOAs are still required to annually file Form 199 and pay taxes on net nonmember income.
Beginning January 1, 2019, boards of directors must review their association's financial records on a monthly basis. (Civ. Code §5500.) This includes:
a current reconciliation of the operating accounts,
a current reconciliation of the reserve accounts,
the current year's actual operating revenues and expenses compared to the current year's budget,
the latest bank statements for operating and reserve accounts,
an income and expense statement for the association's operating and reserve accounts, and
the check register, monthly general ledger, and delinquent assessment receivable reports.
It is a written report that evaluates the common area of the association. It provides guidance on how much your association should be setting aside each month for reserves so it can meet its future obligations without special assessments. Reserves are needed to pay for the replacement of common area components such as roofs and parking lots and to pay for major maintenance items such as exterior painting. The California Civil Code sets forth the minimum requirements for reserve studies.
